Jaden Smith Seeking Emancipation From Parents Will & Jada Pinkett-Smith For His 15th Birthday? He & Will Shoot Down Rumor [Video]





Jaden Smith's 15th birthday arrives on July 8th. According to a rumor the teen actor/rapper wants to be emancipated from his superstar parents, Will and Jada Pinkett-Smith.

“He says, ‘Dad, I want to be emancipated.’ I know if we do this, he can be an emancipated minor, because he really wants to have his own place, like ooh," Will told The Sun recently. “That’s the backlash. On the other side, if kids just want to have command of their lives, I understand. We generally don’t believe in punishment. From the time Jaden was five or six we would sit him down, and all he has to do is be able to explain why what he did was the right thing for his life."



According to Fox, even if Jaden's parents agree with his decision it still has to be approved by the courts.

“While it may sound cool to a young teenager to have ‘freedom’ from his or her parents, the decision to emancipate should not be taken lightly by the minor, the parents or the court. We certainly have seen case after case of child stars seeking emancipation to escape unstable home environments, bad parenting or even to avoid certain child labor laws,” California-based attorney, Anahita Sedaghatfar, told FOX411’s Pop Tarts column. “Apparently Jaden Smith seeks emancipation not for any reason other than he wants to have his own place to live. The parents are given the opportunity to consent to the emancipation, but this does not make the process automatic as the court must still approve the proceeding. But he will need to show more than he simply wants his ‘freedom,’ He will need to explain to the court why it is in his best interest. Usually these are in cases of abuse or when somebody is stealing money or mismanaging a career. But maybe he wants to travel and not have to go to school,” she surmised. "But if his parents agree and have good cause he [may] be allowed to."


Despite the rumors don't expect Jaden to be going anywhere, at least not for a while. He and his dad appeared on The Ellen DeGeneres Show yesterday and said the rumors weren't true. Will said his comments to The Sun were a joke.


"Here's the thing I need to explain. I'm not going anywhere," Jaden said. "The thing people don't understand is everything a [my dad's] house is free. So I can get anything and everything at his house. So I think I'm gonna be there 20 or 30 more years."
